Об определении необходимых и достаточных пределов правового регулирования воинских отношений
Abstract
Аннотация: в статье рассматривается одна из ключевых специфических особенностей правового регулирования правоотношений в военной среде – детальная регламентация прав, обязанностей, порядка исполнения возложенных функций и приказов. К причинам подобного подхода автор относит историческую традицию, воспитание послушания и дисциплины, методическую помощь исполнения возложенных обязанностей для неопытных в данных вопросах командирах, а также удобство контроля и желание унифицировать воинскую деятельность в различных воинских формированиях. Дисфункциональными проявлениями данного стиля управления являются воспитание несамостоятельности в вопросах принятия решений, привычка во всем полагаться на вышестоящее руководство, утрата подчиненными инициативы умения работать в команде, снижение оперативности реакции на внезапные изменения обстановки и нетиповые ситуации. В условиях боевых действии указанные недостатки не просто снижают эффективность управления, но и с большой вероятностью приведут к поражению и неоправданным жертвам.
На основе конкретных примеров чрезмерной регламентации автор ставит вопрос о пределах правового регулирования в военной среде. Сопоставляя российскую и англосаксонскую модели военного управления, автор предлагает перенять полезные черты последней. В частности, децентрализацию механизма и способов полученных команд и возложенных на воинское должностное лицо функций. Также предлагается устранить юридическую ответственность воинских командиров за отклонение от требований детальных приказов в случае совершения ими обоснованного риска и отсутствия вреда охраняемым законом интересам.
При подготовке статьи использовались методы формальной логики – сравнение, описание, классификация, анализ, синтез и др., которые позволили охарактеризовать сущность рассматриваемых правоотношений и сопоставить их с методами правового регулирования соответствующих трудовых отношений.
