Комплексный анализ Конституции Российской Федерации, действующего административного и административно-процессуального законодательства Российской Федерации показывает, что административное усмотрение публичной администрации Российской Федерации проявляется в рамках административно-публичных функций, осуществляемых компетентными органами исполнительной власти, органами местного самоуправления, организациями, имеющими статус государственного или иного органа, их уполномоченными должностными лицами. При данном подходе в сопоставлении с систематизированными административно-публичными функциями раскрывается структура современного административного усмотрения публичной администрации Российской Федерации (в том числе выделяются отдельные виды административного усмотрения в пределах административного распорядительства и административно-правовой охраны). Устанавливается взаимосвязь административного усмотрения публичной администрации Российской Федерации с административным правосудием, осуществляемым Верховным Судом Российской Федерации, судами общей юрисдикции, арбитражными судами. На основе комплексного анализа Кодекса административного судопроизводства Российской Федерации, Арбитражного процессуального кодекса Российской Федерации, Кодекса Российской Федерации об административных правонарушениях аргументируется, что усмотрение публичной администрации как объект административного правосудия проявляется в рамках административно-защитного правосудия, административно-принудительного правосудия, административно-санкционирующего правосудия. Представленный комплексный подход к оценке структуры современного административного усмотрения публичной администрации Российской Федерации и его взаимосвязи с административным правосудием предложено использовать в целях научно обоснованного выявления и конкретизации норм административного и административно-процессуального законодательства, устанавливающих чрезмерное административное усмотрение органов исполнительной власти, органов местного самоуправления, организаций, имеющих статус государственного или иного органа, их уполномоченных должностных лиц, которое, в свою очередь, приводит к принятию конкурирующих судебных решений по административным делам различной категории, подрывающих единообразие административного правосудия.</p></abstract><trans-abstract xml:lang="en"><p>The article evaluates the principal doctrinal approaches to administrative discretion developed during the Soviet and post-Soviet periods of the Russian state. A comprehensive analysis of the Constitution of the Russian Federation, current administrative legislation, and administrative-procedural legislation substantiates the concept of administrative discretion exercised by the public administration. Such discretion demonstrates itself within the framework of administrative-public functions performed by competent executive authorities, local self-government bodies, organisations endowed with publicauthority status, and their authorised officials. Using this approach, the Author examines the structure of modern administrative discretion in the Russian public administration by comparing it with systematised administrative-public functions, identifying, inter alia, distinct types of discretion exercised in administrative management and in administrative-legal protection. The article further establishes the connection between administrative discretion of the public administration and administrative justice exercised by the Supreme Court of the Russian Federation, courts of general jurisdiction, and arbitrazh courts. A comprehensive analysis of the Code of Administrative Procedure, the Arbitration Procedure Code, and the Code of Administrative Offenses demonstrates that administrative discretion – as an object of administrative justice – manifests itself in three forms: (1) administrative-protective justice, (2) administrative-enforcement justice, and (3) administrative-sanctioning justice. The integrated approach proposed in the article may be used to identify and concretize provisions of administrative and administrative-procedural legislation that confer excessive administrative discretion on executive authorities, local self-government bodies, and organisations with public-authority status – discretion that may lead to inconsistent judicial decisions in administrative cases and undermine the uniformity of administrative justice.</p></trans-abstract><kwd-group xml:lang="ru"><kwd>публичная администрация</kwd><kwd>административное усмотрение</kwd><kwd>административное правосудие</kwd><kwd>административное судопроизводство</kwd><kwd>административные дела</kwd></kwd-group><kwd-group xml:lang="en"><kwd>public administration</kwd><kwd>administrative discretion</kwd><kwd>administrative justice</kwd><kwd>administrative proceedings and administrative cases</kwd></kwd-group></article-meta></front><back><ref-list><title>References</title><ref id="cit1"><label>1</label><citation-alternatives><mixed-citation xml:lang="ru">Соловей Ю.
